Terms of use and disclaimer

These terms cover the Pooldex website and the Pooldex app for iPhone. In short: our numbers are estimates, the label on your product always comes first, purchases go through Apple, and you use the calculators at your own risk.

Agreement

These Terms of Use are an agreement between you and Aliaksandr Rusinski, an individual developer ("we", "us"). They apply to the website at pool-dex.com, the Pooldex app, and their content (together, "Pooldex"). Our chemical safety and product labels page and, if you buy Pooldex Plus, our subscription and purchase terms are part of these terms. How we handle data is explained in the privacy policy. By using Pooldex you accept these terms; if you do not accept them, please do not use it.

Who may use Pooldex

You must be at least 18, or the age of majority where you live, to buy anything in the app and to use Pooldex to plan the handling of pool or spa chemicals. Younger people may use it only under the supervision of a parent or guardian who accepts these terms. You may not use Pooldex where the law, including U.S. sanctions law, prohibits it.

Estimates, not guarantees

Pooldex is an informational calculator and water log. It estimates chemical additions from the numbers you enter (volume, test results, product type and strength) using published water chemistry; our methodology shows the formulas and sources. Results are only as good as the inputs: test strips read in steps, kits and store tests can be wrong, and pool volumes are often estimates. Check your inputs and retest after every change.

Pooldex is not professional pool-service, engineering, medical, or legal advice and does not replace an on-site check by a qualified professional. Nothing in it guarantees that water is sanitary or fit for swimming. We never call your water "safe": we compare your readings with target ranges and with the swim limit on your product's label, and tell you to wait when a reading is outside that limit.

The product label comes first

Pool and spa sanitizers, shock products, and algaecides are pesticides registered with the U.S. Environmental Protection Agency, and federal law makes it illegal to use them in a way their labeling does not allow. Read and follow the label of every product you use, including its directions, maximum doses, precautions, and any "do not swim" or re-entry instructions. If anything in Pooldex differs from a label, follow the label. Pooldex does not recommend using a product for a purpose, site, or dose its label does not allow. Your responsibilities

  • Use Pooldex lawfully, for pools and hot tubs you look after.
  • Follow product labels, safety data sheets, local rules, and your equipment makers' instructions.
  • Keep chemicals away from children and pets, never mix them, and wear eye and hand protection.
  • Do not rely on Pooldex in an emergency: call 911, or Poison Control at 1-800-222-1222.
  • Do not copy, resell, reverse engineer, or disrupt the app or the site, or use them to build a competing product. Our published data sets are the exception: you may reuse them under the license shown next to each one.

Pooldex is built for residential pools and hot tubs. Public and commercial pools must follow state and local health codes and the instructions of a certified operator, and Pooldex is not a substitute for either.

Purchases in the app

Pooldex Plus is sold only as an in-app purchase through Apple's App Store: a yearly subscription that renews automatically until you cancel, a Season Pass that does not renew, and a one-time Lifetime purchase. Apple bills you and handles cancellation and refunds; we cannot issue refunds ourselves. Prices, renewal, the free trial, and how to cancel are set out in our subscription terms. Nothing in these terms limits consumer rights that the law does not allow us to limit.

License and ownership

We give you a personal, limited, non-exclusive, non-transferable, and revocable license to use the app on Apple devices you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow, and to use the website. We and our licensors keep all other rights in Pooldex, including its software, text, graphics, and name.

Brand names such as Intex, Bestway, Coleman, Taylor, Hayward, Pentair, and Clorox belong to their owners. We use them only to identify products; none of them sponsors or endorses Pooldex.

Your content

Your logs, notes, and settings belong to you and stay on your device and in your iCloud, as the privacy policy explains. If you send us something, for example in a support email, you allow us to use it only to help you and to fix problems. If you send ideas or suggestions, we may use them without any obligation to you.

Pool capacities, product strengths, and reference values come from manufacturers, labels, and published sources, with the date we read them. Manufacturers change products and pages without notice; where we could not confirm a value on the manufacturer's own page, we say so. If your pool's manual or your product label says something different, trust the manual or the label. Pooldex relies on Apple services (iCloud and the App Store) and links to other websites; their own terms apply to them, and we are not responsible for them.

There are no affiliate links today. If we add them, we may earn a commission when you buy through them, at no extra cost to you. We will label them where they appear, and they will never change a calculator result.

Changes to the site and app

We may update, change, or stop any part of the website or the app. We do not have to provide updates or support, except where the law requires it or where a paid offer promised it at the time of purchase.

Disclaimer of warranties

TO THE FULLEST EXTENT ALLOWED BY LAW, THE WEBSITE AND THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CALCULATIONS, TARGET RANGES, REMINDERS OR OTHER CONTENT WILL BE ACCURATE, COMPLETE OR SUITABLE FOR YOUR POOL, SPA, EQUIPMENT OR PRODUCTS, OR THAT THE WEBSITE OR THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. YOU USE THEM AT YOUR OWN RISK.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR DAMAGE TO POOLS, SPAS, SURFACES OR EQUIPMENT, ARISING FROM OR RELATED TO THE WEBSITE OR THE APP, EVEN IF WE WERE TOLD THAT SUCH DAMAGES WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE WEBSITE OR THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP AND IN-APP PURCHASES IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR US $50.

These limits do not apply to liability that cannot be limited or excluded under applicable law, which in some places includes liability for death or personal injury caused by negligence, and for fraud, gross negligence, or willful misconduct. If the law where you live does not allow part of this section, the warranty section, or the indemnity section, that part does not apply to you.

Indemnity

To the extent the law allows, you agree to indemnify and hold us harmless against claims by third parties that arise from your misuse of Pooldex, your breach of these terms, or your breach of any law or product label.

Disputes and governing law

If you have a problem with Pooldex, please email us first. Before either of us starts a formal claim, we both agree to try to resolve it informally for 60 days after one side sends the other a written description of the claim and the relief it wants. Either of us may bring an individual claim in small-claims court.

Wherever you live, you keep the protection of the mandatory consumer laws of your home state or country.

Notices for California and for EU and UK consumers

California residents: under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

EU and UK consumers: you benefit from the mandatory consumer protections of the country where you live, and nothing in these terms affects your statutory rights.

If you got the app from the App Store

  1. These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
  2. Your license is limited to using the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  3. Apple has no obligation to provide any maintenance or support for the app.
  4. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not disclaimed in these terms.
  5. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  6. If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  7. You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. You must comply with applicable third-party terms, such as your wireless data service agreement, when using the app.
  9. Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you as a third-party beneficiary.
  10. Questions, complaints or claims about the app go to the contact details at the end of these terms.

Changes and ending

We may update these terms as the site and the app change. The "Last updated" date at the top shows the current version. For a material change we will tell you on the site, or in the app once it is released, before it takes effect; using Pooldex after that means you accept the updated terms. You can stop using Pooldex at any time, and we may end your access if you seriously break these terms. The sections on estimates and labels, your content, warranties, liability, indemnity, and disputes still apply after that.

If part of these terms cannot be enforced, the rest still applies, and not enforcing a part is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition, or sale of the business. These terms, the pages they name, and the privacy policy are the whole agreement between you and us about Pooldex.
